Air Care Heating & Cooling 10-Year Labor Warranty Terms and Conditions
- Overview of Extended Warranty Offering
Air Care Heating & Cooling is pleased to offer an exclusive 10-year labor warranty for new installations of HVAC systems. To qualify for the 10-year labor warranty, clients must meet specific maintenance and service conditions outlined below.
- Eligibility for the 10-Year Labor Warranty
To qualify for the 10-year labor warranty, the following conditions must be met:
Annual Maintenance: The HVAC system must undergo a full annual maintenance by Air Care Heating & Cooling each year. This maintenance must be scheduled and performed by our qualified technicians. The maintenance includes inspections, cleaning, adjustments, and servicing of the system as recommended for optimal performance.
Exclusive Maintenance Provider: During the warranty period, the system must only be maintained by Air Care Heating & Cooling. Any maintenance, repairs, or service work performed by another service provider—whether on the system’s components or otherwise—will automatically void the 10-year labor warranty.
Documentation of Maintenance: Air Care Heating & Cooling must have documented proof of each annual maintenance performed. We will maintain a digital record of each maintenance visit, and clients are also encouraged to keep their own records for reference.
- Annual Maintenance Requirement
To maintain the validity of the 10-year warranty, the client must ensure the following:
Scheduled Annual Maintenance: Clients must schedule and complete a full annual maintenance appointment with Air Care Heating & Cooling within 12 months of the previous visit. The maintenance must include a thorough system inspection, cleaning, and necessary adjustments.
Failure to Complete Maintenance: If any annual maintenance appointment is missed or delayed by more than 30 days, the system will automatically be downgraded to a 3-year labor warranty, regardless of the original 10-year warranty status.
- Warranty Downgrade for Missed Maintenance or Unauthorized Service
If the system fails to meet the conditions above, the following will apply:
If annual maintenance is not completed on time, or if the system is worked on by any other service provider, the 10-year labor warranty will be automatically downgraded to a 3-year labor warranty.
This downgrade is permanent and cannot be reinstated to the 10-year term, even with future maintenance or service from Air Care Heating & Cooling.
- Scope of Warranty
Labor Warranty: The 10-year labor warranty covers the labor costs associated with the repair or replacement of defective components, as specified in the warranty contract.
Parts Warranty: Parts may be covered under manufacturer warranties, which are separate from the labor warranty.
Exclusions: The warranty does not cover damages resulting from neglect, misuse, failure to adhere to the maintenance and service terms outlined herein, or any act of God (including, but not limited to, natural disasters such as floods, earthquakes, tornadoes, or severe storms).
- Maintenance Services
Air Care Heating & Cooling will provide all maintenance services, which include, but are not limited to:
Complete system inspection and testing
Cleaning of filters, coils, and components
Refrigerant checks and adjustments
Electrical connection inspection and adjustment
General system tune-ups and optimization
- Transferability
The 10-year labor warranty is non-transferable. If the property is sold or the ownership changes, the warranty will automatically revert to a 3-year labor warranty.
- Termination of Warranty
The warranty may be terminated by Air Care Heating & Cooling under the following conditions:
Failure to schedule or complete the required annual maintenance.
Unauthorized maintenance, repairs, or servicing by another provider.
Abuse, neglect, or misuse of the HVAC system.
Failure to comply with all terms and conditions outlined in this document.
- Client Responsibilities
Scheduling Maintenance: It is the client’s responsibility to schedule and ensure the HVAC system is serviced by Air Care Heating & Cooling on time each year.
Record Keeping: While Air Care Heating & Cooling will keep digital records of each maintenance visit, clients should also keep personal records to ensure continuity of the warranty.
- Limitations of Liability
Air Care Heating & Cooling’s liability under this warranty is limited to the repair or replacement of defective labor only. We are not responsible for any indirect, incidental, or consequential damages resulting from the use or failure of the system.
- Agreement and Acknowledgment
By accepting the 10-year labor warranty, the client acknowledges and agrees to all terms and conditions outlined in this document, including the requirement to schedule annual maintenance and the exclusive use of Air Care Heating & Cooling for all maintenance and repairs during the warranty period. If the client fails to adhere to these terms, the warranty will be downgraded to a 3-year labor warranty.
