CARE CLUB MEMBERSHIP AGREEMENT TERMS & CONDITIONS
By enrolling in the Care Club Membership Program, the customer acknowledges and agrees to the following terms and conditions:
1. Membership Services Air Care Heating & Cooling agrees to provide the maintenance services and membership benefits associated with the selected membership plan. Maintenance services will be performed during normal business hours unless otherwise stated in the selected plan.
Maintenance visits include inspection and maintenance services based on the selected membership level and equipment covered under this agreement.
2. Customer Responsibilities The customer agrees to: • Operate and maintain the equipment according to manufacturer recommendations and instructions provided by Air Care Heating & Cooling. • Promptly notify Air Care Heating & Cooling of any unusual equipment operation or performance concerns. • Provide safe and reasonable access to equipment during scheduled service appointments. • Maintain active utilities necessary for servicing the equipment.
3. Scheduling & Maintenance Visits Scheduled maintenance visits must be completed within the active membership term. Missed, declined, cancelled, or postponed visits do not roll over into future membership terms unless otherwise approved in writing by Air Care Heating & Cooling.
Air Care Heating & Cooling will make reasonable efforts to contact the customer for scheduling; however, it is ultimately the customer’s responsibility to schedule maintenance visits during the membership term.
4. Membership Benefits Membership discounts, priority scheduling, warranties, loyalty credits, and other membership benefits apply only while the membership remains active and in good standing.
Membership benefits and discounts have no cash value and may not be redeemed for cash, credit, or prior services.
Club Loyalty credits may only be applied toward qualifying services, repairs, accessories, or equipment purchases offered by Air Care Heating & Cooling and may not be exchanged for cash.
5. Repair & Warranty Limitations Repair warranties provided under the membership apply only to repairs performed by Air Care Heating & Cooling.
Equipment failures caused by abuse, misuse, neglect, acts of nature, power surges, improper maintenance by others, vandalism, fire, flood, wind, or unauthorized modifications are excluded from coverage.
Replacement parts, repairs, or services not specifically covered under the membership agreement may result in additional charges.
6. Cancellation & Refund Policy Memberships may be cancelled at any time by providing written notice to Air Care Heating & Cooling.
If cancellation occurs after services, discounts, maintenance visits, loyalty credits, filters, cleanings, or other membership benefits have been provided, the value of those services and benefits received will be deducted from any eligible refund amount.
If the total value of services and benefits received equals or exceeds the amount paid for the membership, no refund will be issued.
Any remaining eligible refund amount will be prorated based on the unused portion of the membership term after deducting the value of services and benefits already received.
7. Transferability Membership agreements may be transferred to a new homeowner for the covered property with written notice to Air Care Heating & Cooling within thirty (30) days of property transfer.
8. Limitation of Liability Air Care Heating & Cooling will exercise reasonable care in performing services under this agreement but shall not be liable for incidental, indirect, special, or consequential damages resulting from equipment failure, delays, acts beyond reasonable control, or conditions unrelated to services provided.
9. Agreement Modifications Air Care Heating & Cooling reserves the right to modify membership pricing, benefits, and terms upon renewal of the membership term. Any changes will not affect the current active membership term already paid for by the customer.
10. Entire Agreement This agreement constitutes the entire understanding between the customer and Air Care Heating & Cooling regarding the Care Club Membership Program and supersedes prior discussions or representations related to the membership.
Dryer Vent Cleaning
Where included as a membership benefit or promotional service, complimentary dryer vent cleaning is limited to dryer vents that are safely and reasonably accessible at the time of service.
If access to the dryer vent requires moving the dryer or any other personal property, the customer is responsible for relocating such items prior to the scheduled appointment. Air Care Heating & Cooling technicians will not move dryers, appliances, furniture, or personal property.
If the dryer vent is not accessible at the time of service, Air Care Heating & Cooling reserves the right to decline the dryer vent cleaning portion of the service. In such cases, no credit, refund, or substitution of services will be provided.
Air Care Heating & Cooling is not responsible for any damage to dryers, appliances, flooring, walls, personal property, or utility connections resulting from customer attempts to move or reposition appliances before or after service.
